1. ELIGIBILITY
The Tex Software Rolex Giveaway Sweepstakes (the "Sweepstakes") is open to legal residents of the United States who are at least eighteen (18) years of age or the age of majority in their state of residence, whichever is older, at the time of entry. Employees, officers, and directors of Tex Software (the "Sponsor"), its parent companies, subsidiaries, affiliates, advertising and promotion agencies, and any other entity involved in the development or administration of this Sweepstakes, and their immediate family members and/or persons living in the same household, are not eligible to participate.
2. SPONSOR
The Sweepstakes is sponsored by Tex Software, located at 38 Keyes Ave, Ste 208 (the "Sponsor").
3. SWEEPSTAKES PERIOD
The Sweepstakes begins on [Start Date] at [Start Time] Pacific Time and ends on [End Date] at [End Time] Pacific Time (the "Sweepstakes Period"). The Sponsor's computer or timekeeping device shall be the official timekeeping device for the Sweepstakes.
4. HOW TO ENTER
During the Sweepstakes Period, enter by visiting the Tex Software booth at Conexpo-Con/Agg.
Visit the Tex Software booth at N10200 and complete an official entry form with your full legal name, email address, phone number, and mailing address.
Entry Allocation. Each eligible entrant will receive one (1) entry into the Sweepstakes upon submission of a valid entry. Entrants who attend a qualifying software demonstration hosted by Sponsor during the Sweepstakes Period will receive four (4) additional entries. Limit five (5) total entries per person.
5. DRAWING AND WINNER SELECTION
On or about Friday March 6th, 2pm PST one (1) winner will be selected in a random drawing from among all eligible entries received during the Sweepstakes Period. The drawing will be conducted by the Sponsor or its designated representative, whose decisions are final and binding in all matters relating to this Sweepstakes. The odds of winning depend on the total number of eligible entries received.
6. PRIZE
One (1) Grand Prize: One (1) Rolex Datejust, with an approximate retail value ("ARV") of $6,400. Prize is awarded "as is" with no warranty or guarantee by the Sponsor. The prize is non-transferable and no substitution or cash equivalent will be provided, except at the Sponsor's sole discretion. The Sponsor reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable.
The winner is solely responsible for all applicable federal, state, and local taxes, including income taxes, and any other costs and expenses associated with prize acceptance and use not specified herein as being provided.
7. WINNER NOTIFICATION
The potential winner will be notified by email and phone number on Friday March 6th at or around 2pm PST. The potential winner may be required to execute and return an Affidavit of Eligibility and a Liability Release. If the potential winner cannot be contacted, fails to return the required documents within the specified time period, or if the prize notification is returned as undeliverable, the potential winner forfeits the prize and an alternate winner may be selected at the Sponsor's discretion.
8. GENERAL CONDITIONS
By entering the Sweepstakes, each entrant agrees to abide by these Official Rules and the decisions of the Sponsor, which are final and binding in all respects. The Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes if fraud, technical failures, or any other factor beyond the Sponsor's reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by the Sponsor in its sole discretion.
9. RELEASE AND LIMITATIONS OF LIABILITY
By entering, entrants agree to release and hold harmless the Sponsor, its parent companies, subsidiaries, affiliates, advertising and promotion agencies, and all of their respective officers, directors, employees, agents, and representatives (collectively, the "Released Parties") from and against any and all claims, damages, liabilities, costs, and expenses arising from or related to: (a) participation in the Sweepstakes; (b) acceptance, possession, use, or misuse of any prize; or (c) any typographical or other error in the printing, offering, or announcement of any prize. The Released Parties are not responsible for lost, late, misdirected, damaged, incomplete, or illegible entries, or for any computer, online, telephone, or technical malfunctions that may occur.
10. PRIVACY
Personal information collected from entrants is subject to the Sponsor's Privacy Policy, available at [URL]. Information collected will be used for the purpose of administering the Sweepstakes and as otherwise described in the Privacy Policy. By entering, entrants consent to the collection and use of their personal information as described herein and in the Sponsor's Privacy Policy.
11. DISPUTES AND GOVERNING LAW
This Sweepstakes and these Official Rules shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of laws principles. Any disputes arising out of or relating to this Sweepstakes shall be resolved exclusively in the state or federal courts located in Clark County, Nevada. By entering, each entrant consents to the personal jurisdiction of such courts.
12. WINNERS LIST
For the name of the winner, available after March 6th, send a self-addressed, stamped envelope to: Tex Software Rolex Giveaway Sweepstakes - Winners List, 38 Keyes Ave, Ste 208. Requests must be received by March 25th.
13. TAX REPORTING
The Sponsor will issue an IRS Form 1099-MISC to the winner for the value of the prize if required by applicable law. The winner may be required to provide a valid Social Security Number or Taxpayer Identification Number prior to receiving the prize.
